Donald Trump: If I Was Appointing Justices, That Wouldn’t Have Happened

Three days later, Donald Trump finally responded to the Supreme Court’s Whole Woman’s Health opinion, saying if he were president, the court would have ruled differently, despite the 5-3 majority decision.

In response to criticisms from many Christian conservatives, Trump was discussing what he would do as president with regard to the Supreme Court with nationally syndicated radio host Mike Gallagher. Trump noted he has already released his “superstar” list of potential high court nominees when the host brought up Monday’s opinion.

“Now there’s your first example right there,” he said. “If Scalia was living, or if Scalia was replaced by me, you wouldn’t have had that, OK? It would’ve been the opposite.

“That’s your first example, and it’s going to be the first of many. If [Hillary Clinton] gets in, you won’t even have to question. You won’t even have to bother going to court. You’re going to know the answers right from the start.”

Gallagher then tried to button down the Republican presidential nominee-in-waiting’s response to the high court opinion. He asked for confirmation that, if he were president, the Supreme Court wouldn’t have had a 5-3 decision to strike down a state law restricting abortion.

“No, I—you wouldn’t see that. And people understand that,” he said. “Now you know, when you appoint judges sometimes, they change their minds. Because you had that in the case of ObamaCare with John Roberts. I mean, who would’ve thought that could’ve happened?

“He could’ve killed it twice, but he didn’t. That was terrible, and it was a [George W. Bush] appointment. That was so bad, what happened, and to me, almost not recoverable from his standpoint.”
